Individual Depositor Policy

The following policy statement outlines the roles, rights and responsibilities of an individual depositor to BDEARS.

An individual depositor

An individual depositor is any person who submits an item to BDEARS. 

Responsibilities of an individual depositor

An individual depositor agrees to:

  1. Ensure the items submitted meet all the criteria laid out within the BDEARS Collection Policy
  2. Ensure that he/she either
  • holds the copyright for items submitted or
  • has obtained appropriate copyright permission for items submitted when he/she is not the copyright holder
  • Understand and observe all BDEARS policies.

Responsibilities BDEARS take on for an individual depositor

BDEARS agrees to:

  1. Ensure items submitted by the depositor are preserved according to the BDEARS Digital Preservation Policy;
  2. Provide permanent and reliable access to items;
  3. Distribute content according to BDEARS policies;
  4. Provide support and guidance to the individual depositor for any questions pertaining to BDEARS or BDEARS policies and guidelines;
  5. As necessary, work with the individual to deposit large numbers of items at once; and
  6. Publicly post notifications of significant changes to content management, software, or policies and procedures.

Rights retained by an individual depositor

An individual depositor retains the right to:

  1. Copyright for any work he/she has submitted. Contributors retain all copyright permissions for any works submitted into the BDEARS repository;
  2. Limit access to content at an item level for any item he/she has submitted;
  3. Request a submitted item be withdrawn; and
  4. Receive a copy of his/her submitted items upon request.

Rights BDEARS retains regarding individual depositors

BDEARS retains the right to:

  1. Review, amend, and redistribute metadata for any item in BDEARS;
  2. Refuse or withdraw any item that does not comply with the BDEARS Collection Policy;
  3. Perform any necessary format changes to items to ensure the preservation of content, based on the BDEARS Digital Preservation Policy;
  4. Charge a fee for activities requiring extensive centralized support by the Library Collections Management staff (decided on a case-by-case basis); and
  5. Renegotiate terms of the original agreement with individual depositors.
